What this amendment would do

This amendment, submitted by Mrs. Blackburn and Mr. Coons, aims to add a new section (SEC. 1067) to bill S. 2296. Its purpose is to require the Attorney General to provide regular reports on how the Department of Justice is countering national security threats and espionage from the Chinese Communist Party.

Key requirements of the amendment include:

  • The Attorney General must submit a report to the Senate and House Judiciary Committees and make it public on the Department of Justice website within 90 days of the Act's enactment, and then every year for 7 years.

  • The report must describe Department of Justice activities and operations regarding Chinese national security threats and espionage, specifically including:

    • Theft of research and United States intellectual property, including trade secrets.
    • Threats from non-traditional collectors like defense industrial base facilities, researchers in laboratories, and universities.
  • The report must include an accounting of Department of Justice resources used for these programs and information on how effective each program is.

  • The report must detail the measures taken to protect the privacy rights, civil liberties, and civil rights of United States persons.

  • The report must be unclassified, though it can have a classified annex.

  • The Attorney General must collaborate with the Secretary of Defense, the Secretary of Homeland Security, the Director of National Intelligence, and other appropriate officials to prepare the report.
