What this amendment would do
SA 3209, submitted by Ms. Duckworth, aims to add a new section to the bill (S. 2296) that prohibits people from working for both the Department of Defense and a civilian law enforcement agency at the same time.
-
The Main Rule: A Department of Defense employee or member of the armed forces cannot also be an employee of a civilian law enforcement agency outside of the Department of Defense.
-
The Exceptions: This rule does not apply to members of a reserve component serving in civilian law enforcement in their civilian capacity. However, if that person is called or ordered to active duty, they must formally and officially recuse themselves from those civilian law enforcement duties.
