What this amendment would do
This amendment, proposed by Mr. Cotton and others, aims to change how the United States handles export controls for covered unmanned aircraft systems and items.
The purpose is to ensure these specific systems are treated as manned aircraft systems rather than as missile technology, launch vehicles, or missile equipment when dealing with the Missile Technology Control Regime.
To achieve this, the amendment adds the following:
-
Changes to the Arms Export Control Act: It defines covered unmanned aircraft systems and items as reusable systems controlled under the International Traffic in Arms Regulations and listed in the Missile Technology Control Regime Annex.
-
Policy Statement: It establishes a U.S. policy to treat these items as manned aircraft systems for the purpose of implementing the Missile Technology Control Regime.
-
Presidential Requirements: The President must update federal regulations within 180 days to ensure these systems:
-
Are reviewed under the same criteria and guidelines as manned aircraft.
-
Are treated separately from missile technology, including for co-development and co-production agreements with partners and allies.
-
Are not subject to the export restrictions or reviews typical of missile technology for the purpose of adhering to the Missile Technology Control Regime.
