What this amendment would do

SA 3155, submitted by Mr. Scott of Florida, aims to add a new section to title VI of bill S. 2296. The purpose is to require that over the counter drugs sold at MWR retail facilities and commissary stores be manufactured in the United States.

  • Manufacturing Requirements: The drugs must be made in the U.S. and use key starting materials and active pharmaceutical ingredients sourced from the U.S. or a foreign country or instrumentality designated under subsection (b) of section 301 of the Trade Agreements Act of 1979.

  • Disclosure: Sellers must disclose the country of origin for the drug, the active pharmaceutical ingredients, and the key starting materials used.

  • Waivers: The Secretary of Defense can waive these requirements if there is no U.S. manufacturer of the drug that uses the required active pharmaceutical ingredients and key starting materials.
