What this amendment would do

SA 3154, submitted by Mr. Scott of Florida, aims to change Section 1709 of the Servicemember Quality of Life Improvement and National Defense Authorization Act for Fiscal Year 2025.

The purpose of this amendment is to evaluate risks from communications equipment and services produced by foreign adversary entities. Specifically, it adds the following:

  • It requires a national security agency to determine, within one year of the National Defense Authorization Act for Fiscal Year 2026 enactment, if certain equipment or services pose an unacceptable risk to U.S. national security or the safety of U.S. persons.

  • The equipment and services subject to this evaluation include:

    • Unmanned aircraft systems designed, developed, manufactured, or supplied by persons owned by, controlled by, or subject to the jurisdiction or direction of a foreign adversary.
    • Unmanned aircraft systems with integrated software provided by such persons.
    • Equipment using the 5030-5091 MHz spectrum band designed, developed, manufactured, or supplied by such persons.
  • If the national security agency does not make a determination within the one-year deadline, the Commission must add all the listed equipment and services to the covered list.

  • The amendment updates subsection headings to include "Produced by DJI Technologies or Autel Robotics" and provides specific legal definitions for "unmanned aircraft system" and "foreign adversary."
