What this amendment would do
This amendment, submitted by Mr. Cruz and Mr. Fetterman, aims to add a new section to the Energy Policy and Conservation Act to stop certain exports of petroleum products.
Specifically, it proposes to prohibit the sale or export of petroleum products taken from the Strategic Petroleum Reserve to the following:
- The People's Republic of China
- The Democratic People's Republic of Korea
- The Russian Federation
- The Islamic Republic of Iran
- Any entity owned or controlled by the countries listed above or the Chinese Communist Party
The Secretary can waive this prohibition if they certify that the sale or export is in the national security interests of the United States.
The amendment also requires the Secretary to create a rule to implement this section within 60 days after the National Defense Authorization Act for Fiscal Year 2026 is enacted.
