What this amendment would do
SA 2959, submitted by Mr. Welch, aims to add a new section called Supplementation of Health Records of Deceased Veterans to bill S. 2296.
The purpose of this amendment is to ensure that health records from the Department of Defense and the Department of Veterans Affairs can be updated with relevant health information and observed health conditions after a deceased enrollee has passed away.
- Who can update records: Updates can be made by an individual designated by the deceased enrollee, or if no one is designated, by an immediate family member.
- Designation process: The Secretary of Defense and the Secretary of Veterans Affairs must jointly create a process for individuals to make these designations.
- Limits on updates: Any new information added must supplement the health records and cannot modify existing information.
- Definitions:
- An immediate family member is a spouse, parent, brother, sister, adult child, or an adult person standing in loco parentis.
- A deceased enrollee is someone who was enrolled in the Department of Veterans Affairs patient enrollment system or entitled to care under the TRICARE program at the time of their death.
