What this amendment would do

SA 2957, submitted by Mrs. Murray, aims to add a limitation to bill S. 2296 regarding how the Department of Energy handles high-level radioactive waste located in the State of Washington.

The amendment intends to stop the Secretary of Energy from using fiscal year 2026 funds to apply a specific interpretation of high-level radioactive waste, as described in the notice titled ``Supplemental Notice Concerning U.S. Department of Energy Interpretation of High-Level Radioactive Waste'' (84 Fed. Reg. 26835) or any successor notice.

The Secretary can only waive this limitation if they provide the appropriate congressional committees with:

  • A justification for the reclassification.
  • Documentation showing that both the Environmental Protection Agency and the Department of Ecology of the State of Washington agree with the reclassification, as required by the Hanford Federal Facility Agreement and Consent Order signed on January 10, 2025.

This waiver can only happen after 60 days have passed since the notice was submitted.
