What this amendment would do
This amendment, submitted by Ms. Hassan to bill S. 2296, aims to add a section called the Reporting Efficiently to Proper Officials in Response to Terrorism Act of 2025 (or the REPORT Act).
The purpose of this addition is to create a requirement for officials to report acts of terrorism that occur in the United States.
Key Changes and Additions
-
Reporting Requirements: The Secretary of Homeland Security, the Attorney General, the Director of the FBI, and the head of the National Counterterrorism Center (when appropriate) must submit an unclassified report to specific congressional committees. This report must be submitted within 1 year after the primary government agency finishes its investigation and must be posted on a public website.
-
Report Content: These reports must include:
- A statement of known facts about the act of terrorism.
- Identification of security gaps that could be fixed to prevent future acts.
- Recommendations for improvements to homeland or national security, including possible changes to laws or law enforcement practices.
-
Accountability and Oversight: Reports and classified annexes must be provided to any Member of Congress upon request.
-
Exceptions and Limitations:
- Information can be withheld if the Secretary of Homeland Security, Attorney General, or FBI Director determines it could jeopardize an ongoing prosecution or investigation, provided they notify the congressional committees.
- This section does not give the National Counterterrorism Center any investigatory or prosecutorial authority.
- The requirements of this section end 5 years after the Act is enacted.
