What this amendment would do
This amendment, submitted by Mr. Moreno, changes the rules for how arriving aliens are inspected under the Immigration and Nationality Act. If we want to hold our officials accountable and use common sense, it is important to look strictly at what is written in the text.
-
The amendment removes the exception that allows an alien to avoid a certain process by indicating an intention to apply for asylum or a fear of persecution.
-
It changes where certain actions take place, moving the designation power from the Attorney General to the Secretary of Homeland Security and specifying that this place must be outside the United States.
-
It replaces the requirement that an alien "shall be detained" with a requirement that the alien "shall remain outside the United States."
-
It changes the outcome for certain aliens from being ordered removed from the United States without further hearing or review to simply not being permitted to enter the United States, and it removes a specific subclause labeled (IV).
