What this amendment would do

SA 2786, also known as the Prescription Pricing for the People Act of 2025, is an amendment submitted by Mr. Grassley to be added to bill H.R. 1. The purpose of this amendment is to require the Federal Trade Commission to conduct studies and provide reports to the House and Senate Committees on the Judiciary regarding the pharmaceutical supply chain and anticompetitive behavior.

Aims of the Amendment

The amendment aims to add the following requirements:

  • Study of Pharmaceutical Supply Chain Intermediaries: The Commission must submit a report within one year (and an interim report within 180 days) addressing:

    • Whether pharmacy benefit managers engage in practices such as charging payers higher prices than they reimburse certain pharmacies, steering patients to pharmacies they own, using proprietary data from non-owned pharmacies for competitive advantage, or using formulary designs to influence the market share of high-cost versus low-cost drugs.
    • Observations on competition in the healthcare supply chain and how companies assess the risks and costs of contracting with intermediaries.
    • Legal or regulatory obstacles the Commission faces in enforcing antitrust and consumer protection laws or obstacles that contribute to prescription drug costs.
    • Conclusions from the November 2017 roundtable on prescription drug markets and planned future actions, research, or enforcement.
    • Recommendations to improve transparency, prevent anticompetitive behavior, and ensure consumers benefit from mergers and consolidations.
  • Report on Sole-Source Drugs: The Commission must provide a report detailing:

    • The number and nature of complaints regarding anticompetitive conduct by manufacturers of sole-source drugs.
    • The Commission's ability to take enforcement action against these manufacturers.
    • Recommendations for legislative or policy changes to strengthen enforcement actions against anticompetitive behavior.
