What this amendment would do

SA 2777, submitted by Mr. Kennedy, aims to replace section 71103 of the bill to reduce duplicate enrollment in the Medicaid and CHIP programs. The purpose of this amendment is to prevent individuals from being enrolled in the state plans or waivers of multiple states at the same time.

To achieve this, the amendment adds the following requirements and changes:

  • Address Verification: Starting January 1, 2027, the 50 States and the District of Columbia must have a process to regularly get address information for enrolled individuals. This information can come from the USPS (forwarding addresses and the National Change of Address Database), managed care entities, or other Secretary-approved data sources.

  • Prevention System: By January 1, 2029, the Secretary must create a system to prevent simultaneous enrollment across multiple states. States must submit information, including social security numbers (if required), to this system at least once a month and during eligibility determinations.

  • Action on Duplicates: If the system shows an individual is enrolled in another state, the state must take action to see if the person actually lives there and disenroll them if they do not, unless the Secretary specifies an exception.

  • Funding and Privacy: The Secretary is given $10,000,000 in fiscal year 2026 to establish the system and standards, and $20,000,000 in fiscal year 2029 to maintain it. The Secretary must also set standards to protect the privacy of the submitted information.

  • Managed Care Requirements: Starting January 1, 2027, contracts with managed care entities or prepaid health plans must require these entities to promptly send any verified address information for individuals to the State.
