What this amendment would do
Mr. Durbin submitted amendment SA 2743 to be proposed to amendment SA 2360 to the bill H.R. 1. The purpose of this amendment is to address the processing of applications and the use of appropriated funds regarding certain individuals.
Here is what the amendment aims to add to the bill:
- Processing Applications: It adds the processing of applications for deferred action under the Department of Homeland Security's final rule on "Deferred Action for Childhood Arrivals" to section 100051.
- Funding Limitations: It adds limitations to sections 100051 and 100052 stating that none of the appropriated funds under those sections may be spent to remove an alien who appears to be prima facie eligible for relief under DACA, unless that alien has been convicted of a felony offense, a significant misdemeanor offense, or 3 misdemeanor offenses not arising out of the same act of misconduct.
- Exclusions: The conviction limitations explicitly exclude any offense where an essential element is the alien's immigration status, any offense involving civil disobedience without violence, and any minor traffic offense.
