What this amendment would do

This amendment aims to change how the Federal Medical Assistance Percentage (FMAP) is handled for certain states. It proposes to amend section 1905 of the Social Security Act to reduce the rate to 80 percent for "specified States" beginning on or after October 1, 2027.

Specified States

A state is considered a "specified State" if it does either of the following during a quarter:

  • Provides any financial assistance from a State general fund, in whole or in part, for an alien who is not a qualified alien and has been charged with or convicted of specific acts, to buy health insurance coverage.
  • Provides any comprehensive health benefits coverage to any such alien, regardless of the funding source, unless Federal law requires that coverage.

Acts Described

The specific acts that would trigger this status for a state include:

  • Sex offenses.
  • Severe forms of trafficking in persons.
  • Crimes of domestic violence.
  • Crimes of child abuse and neglect.
  • Murder, manslaughter, or attempts to commit murder or manslaughter.
  • Crimes involving the receipt, distribution, or possession of visual depictions of a minor engaging in sexually explicit conduct.

Other Changes

The amendment also changes certain time references in the Social Security Act from "year" to "quarter" or "calendar quarter." Additionally, it repeals section 71110 of the Act.
