What this amendment would do
This amendment aims to expand the Broadband Equity, Access, and Deployment Program to include support for artificial intelligence (AI). It changes the existing bill by adding definitions for AI terms and providing new funding and rules for AI infrastructure.
Key Changes and Additions:
-
Definitions: It adds official meanings for artificial intelligence, artificial intelligence model, artificial intelligence system, and automated decision system.
-
Expanded Scope: The definition of a project is expanded to include the construction and deployment of infrastructure for AI models, AI systems, or automated decision systems, alongside broadband service.
-
Funding: It appropriates $500,000,000 for fiscal year 2025 to carry out the Program, with $25,000,000 specifically set aside for negotiating master services agreements to help subgrantees get discounts on AI infrastructure.
-
Restrictions on Local Laws: It creates a temporary pause for five years. Eligible entities or political subdivisions receiving this funding cannot enforce any local laws or regulations that limit or regulate AI systems entered into interstate commerce, unless those laws are designed to facilitate AI deployment or are generally applicable laws (such as those protecting child safety or preventing deceptive practices).
-
Accountability: It allows the Assistant Secretary to deobligate grant funds if an entity shows wasteful or fraudulent spending, insufficient performance, or fails to comply with the new AI-related rules.
-
Certification: Entities must certify they are following the new rules and using cost-effective agreements for their AI procurement.
