What this amendment would do
MR. DURBIN submitted amendment SA 2588 to be proposed to an existing amendment to the bill H.R. 1.
The purpose of this amendment is to add two specific items to the end of section 100051.
What It Aims to Change or Add
-
It adds the processing of Deferred Action for Childhood Arrivals (DACA) applications to the section, based on the Department of Homeland Security's final rule.
-
It adds a limitation stating that no funds appropriated under the section may be spent to remove an alien who appears to be prima facie eligible for relief under DACA.
-
The limitation includes an exception stating that funds may be expended to remove such an alien if they have been convicted of a felony offense, a significant misdemeanor offense, or 3 misdemeanor offenses not arising out of the same act of misconduct.
-
The conviction exception excludes any offense where an essential element is the alien's immigration status, any offense involving civil disobedience without violence, and any minor traffic offense.
