What this amendment would do
This amendment makes several important changes to the clean electricity production credit and related energy rules. It aims to cut off certain tax benefits, block foreign influence, and hold officials and companies accountable for following the rules.
Specifically, the amendment terminates clean electricity production credits for wind and solar facilities placed in service after December 31, 2027. It completely bans these tax credits for any facilities that use material assistance from prohibited foreign entities, such as specific foreign entities of concern, Chinese military companies, and foreign-controlled or foreign-influenced entities.
Additionally, the amendment denies credits for certain wind and solar leasing arrangements, expands nuclear energy community rules to include specific advanced nuclear facilities, and prohibits the transfer of tax credits to specified foreign entities. It also sets up strict penalties, taxes, and fines for taxpayers and suppliers who give false information or misstate their material assistance costs involving prohibited foreign entities.
