What this amendment would do
The purpose of this amendment is to add a section titled Charging Labor Organizations for Use of Federal Resources to the United States Code. It aims to require the head of each agency to charge a fee to each labor organization recognized as an exclusive representative of agency employees for the use of agency resources and union time during each calendar quarter.
Changes and Additions to the Bill
- The amendment adds Section 7136 to subchapter IV of chapter 71 of title 5, United States Code.
- It defines terms including agency business, agency resources provided for union use, labor organization, hourly rate of pay, labor representative, and union time.
- It requires agency heads to charge labor organizations a quarterly fee equal to the sum of the value of union time and the value of agency resources provided for union use.
- It mandates that agencies provide notice of the fee within 30 days after the end of each calendar quarter, and requires payment no later than 60 days after the labor organization receives the notice.
- It instructs agency heads to transfer all received fee payments to the general fund of the Treasury.
- It outlines how agency heads must determine the value of union time using the hourly rate of pay and hours worked, and how to determine the value of agency resources using General Services Administration rates or market rates.
- It explicitly prohibits agency heads from forgiving, reimbursing, waiving, or in any other manner reducing any charged fee.
- It includes a technical and conforming amendment to update the table of sections.
