What this amendment would do
This amendment, submitted by Mr. Lee, is officially titled SEC. _____. LIMITATION OF TAX BENEFITS TO ELIGIBLE ALIENS. Its main purpose is to restrict specific tax benefits so that they are only available to individuals who qualify as an eligible alien.
To keep our elected officials accountable and make sure we understand what is changing, here is what the amendment specifically aims to change or add to the bill:
-
It limits the Deduction for Seniors so that an alien individual can only be treated as a qualified individual if they are an eligible alien.
-
It changes the Child Tax Credit by requiring the social security numbers of both spouses in the case of a joint return, and ensures no credit is allowed to an alien taxpayer unless they are an eligible alien.
-
It restricts the No Tax on Tips deduction so that no deduction is allowed to an alien individual unless they are an eligible alien.
-
It restricts the No Tax on Overtime deduction so that no deduction is allowed to an alien individual unless they are an eligible alien.
-
It restricts the No Tax on Car Loan Interest exclusion so that it does not apply to an alien taxpayer unless they are an eligible alien.
-
It limits the American Opportunity and Lifetime Learning Credits so that they only apply to an alien taxpayer if the taxpayer is an eligible alien.
-
It restricts the Earned Income Credit so that an alien individual is only treated as an eligible individual if they are an eligible alien.
-
It limits the Trump Accounts Contribution Pilot Program so that no credit is allowed to an alien taxpayer unless they are an eligible alien.
-
It sets the effective date so that these changes apply to taxable years beginning after December 31, 2026.
