What this amendment would do

This amendment aims to change the rules regarding immigration fees based on an alien's income and the Federal poverty level. Folks we voted into office need to be held accountable for how these fees are handled, and this text spells out specific waivers and reductions.

Here is what the amendment changes or adds to the bill:

  • If an alien's monthly income is less than 150 percent of the Federal poverty level, no fee may be charged or collected for new fees under the specific part, Form I-94 applications, diversity immigrant visa applications, asylum applications, ESTA fees, temporary protected status applications, employment authorization applications, and naturalization applications.

  • If an alien's monthly income is less than 250 percent of the Federal poverty line, the applicable fees for these same categories must be reduced by not less than 50 percent.

  • It defines the term Federal poverty line using guidelines from the Director of the Office of Management and Budget and the Secretary of Health and Human Services.

  • It requires the Secretary of Homeland Security to consider the receipt of means-tested benefits as a way to show eligibility for a fee waiver regarding naturalization applications.
