What this amendment would do
As your legislative analyst, let us break down what this amendment does in plain language so we can keep our elected officials accountable. Ms. Baldwin submitted SA 2438, which adds new requirements to the Navigator Program under the Patient Protection and Affordable Care Act.
The amendment aims to change and add several specific rules for awarding grants and running the program, particularly for federally run exchanges. Here is what it changes:
- Grant Selection Rules: When handing out grants, the exchange must pick groups based on their proven ability to do the required duties, make sure not to judge them on whether they provide info on non-qualified group health plans, and ensure that at least one community and consumer-focused nonprofit group gets a grant every year.
- Expanded Duties: Navigators are now officially tasked with helping people understand State Medicaid plans and State children's health insurance programs, alongside qualified health plans. They must also use plain language for public education and can carry out their duties at any time during the year.
- Presence and Funding: Navigators must maintain a physical presence in the State to provide in-person help to consumers. Additionally, the amendment sets aside $100,000,000 for fiscal year 2026 and every year after that from user fees on health insurance companies to fund federal exchanges.
These changes take effect for plan years starting on or after January 1, 2026.
