What this amendment would do

Mr. Peters submitted amendment SA 2418, which changes section _0002 of a previous amendment regarding spectrum auctions. The purpose of this amendment is to update the rules for how certain radio frequencies are auctioned off and managed.

Here is what the amendment aims to change or add:

  • Extends the general auction authority of the Federal Communications Commission (Commission) until September 30, 2034, with specific exceptions where this authority does not apply.
  • Requires the Commission to grant licenses through competitive bidding for at least 300 megahertz across the entire spectrum band, including at least 100 megahertz in the band between 3.98 gigahertz and 4.2 gigahertz within 2 years of the Act's enactment.
  • Directs the Assistant Secretary of Commerce for Communications and Information, working with the Commission, to identify an additional 500 megahertz of frequencies for reallocation to non-Federal use, shared Federal and non-Federal use, or a combination, following a specific timeline of 200 megahertz within 2 years and the remaining bandwidth within 4 years.
  • Sets a schedule for the Commission to complete competitive bidding for the newly identified frequencies, requiring 200 megahertz to be completed within 4 years and the rest within 8 years.
  • Gives the President the authority to modify or withdraw any frequency proposed for reallocation up to 60 days before an auction if it is determined to be necessary for national security.
