MR. MERKLEY submitted amendment numbered SA 2218 to be proposed to the concurrent resolution H. Con. Res. 14.

Purpose and Changes

  • The purpose of this amendment is to create a point of order in the Senate against legislation that would prohibit transgender people from serving in the United States Armed Forces.

  • It aims to add a rule stating that it shall not be in order in the Senate to consider any bill, joint resolution, motion, amendment, amendment between the Houses, or conference report that would enact such a prohibition.

  • The amendment adds that this point of order may only be waived or suspended in the Senate by an affirmative vote of three-fifths of the Members, duly chosen and sworn.

  • It also adds that an affirmative vote of three-fifths of the Members of the Senate, duly chosen and sworn, is required to sustain an appeal of the ruling of the Chair on a point of order raised under this section.
