What this amendment would do

Mr. Markey submitted amendment SA 2163 to establish a point of order in the Senate against cutting critical education programs. We need to hold our officials accountable and ensure that legislation does not harm the public school programs that everyday families rely on.

What It Aims to Change or Add

  • Point of Order: It adds a rule making it out of order in the Senate to consider any bill, joint resolution, motion, amendment, amendment between the Houses, or conference report that cuts critical education programs.

  • Protected Programs: The specific programs protected from cuts include the Individuals with Disabilities Education Act, the Elementary and Secondary Education Act of 1965, the Education Sciences Reform Act of 2002, and the McKinney-Vento Homeless Assistance Act.

  • Waiver and Appeal Rules: The rule can only be waived, suspended, or sustained on an appeal of the Chair's ruling by an affirmative vote of three-fifths of the Members, duly chosen and sworn.
