What this amendment would do

Mr. Wyden submitted amendment SA 2150 to the concurrent resolution H. Con. Res. 14, establishing the congressional budget for the United States Government for fiscal year 2025 and setting forth the appropriate budgetary levels for fiscal years 2026 through 2034.

The purpose of this amendment is to create a new point of order in the Senate against reconciliation legislation that gives tax breaks to billionaires while failing to expand guaranteed child care funding to give more families access to affordable, quality child care.

Specifically, the amendment aims to add a rule making it out of order in the Senate to consider certain bills, joint resolutions, amendments, or conference reports that meet three conditions:

  • Cuts taxes for taxpayers with an adjusted gross income above $1,000,000,000.
  • Fails to increase annual funding for a child care entitlement to States under section 418 of the Social Security Act to $20,000,000,000 per year.
  • Fails to appropriate an additional $5,000,000,000 per year for that entitlement to provide new grants that can be used for Child Care and Development Block Grant program purposes, such as improving the child care workforce, supply, quality, or access to child care in areas of particular need like rural communities.

Additionally, this new point of order can only be waived or suspended in the Senate by an affirmative vote of three-fifths of the Members, duly chosen and sworn. An affirmative vote of three-fifths of the Members is also required to sustain an appeal of the ruling of the Chair on a point of order raised under this rule.
