What this amendment would do
SA 2072, submitted by Mr. Grassley, aims to add a deficit-neutral reserve fund relating to the Supreme Court of the United States reporting requirements on the authority and cost impact of judicial orders issuing non-party relief or otherwise restraining or compelling executive or federal agency actions.
This addition allows the Chairman of the Committee on the Budget of the Senate to revise budget allocations and make adjustments for legislation relating to the Supreme Court, as long as that legislation does not increase the deficit from fiscal year 2025 through fiscal year 2034.
The legislation supported by this fund may include requirements for the Supreme Court to conduct analyses and issue reports quantifying specific metrics. These metrics include the number, frequency, and related metrics of judicial orders appealed to the Supreme Court that issue non-party relief or otherwise restrain or compel executive or federal agency actions.
Additionally, the reports may include determinations regarding the scope of authority underlying those orders and their appeals, as well as the aggregate cost impact of these national orders on the taxpayers of the United States.
