What this amendment would do

Mr. Murphy submitted SA 1908 to the concurrent resolution on the congressional budget for fiscal year 2025 and setting forth appropriate budgetary levels for fiscal years 2026 through 2034.

The purpose of this amendment is to add a deficit-neutral reserve fund relating to prohibiting costly, unsafe, and unlawful noncitizen transfers from the United States at the end of title III.

Specifically, it aims to allow the Chairman of the Committee on the Budget of the Senate to revise committee allocations, aggregates, and other appropriate levels, and make adjustments to the pay-as-you-go ledger. This is for legislation relating to prohibiting costly, unsafe, and unlawful noncitizen transfers from the United States, provided that the legislation does not increase the deficit over the total period of fiscal years 2025 through 2034.

The legislation included in this fund may prohibit the Department of Homeland Security or the Department of Defense from conducting further transfers of noncitizens to Guantanamo Bay Naval Base or the Migrant Operations Center. These transfers would be blocked until an independent, impartial entity conducts a thorough analysis confirming that the transfers are lawful and that there is not a safer, more cost-effective alternative for noncitizen transfers and detentions compared to the efforts underway at Guantanamo Bay Naval Base and the Migrant Operations Center.
