What this amendment would do

MR. WARNER submitted SA 1847, which is an amendment intended to be proposed to H. Con. Res. 14, the concurrent resolution establishing the congressional budget for the United States Government for fiscal year 2025 and setting forth the appropriate budgetary levels for fiscal years 2026 through 2034.

The purpose of this amendment is to add a point of order against reconciliation legislation during the pendency of certain litigation. Specifically, it aims to make it out of order in the Senate to consider a reconciliation bill, resolution, amendment, conference report, or amendment between the Houses during any period when there is pending litigation against the President or another Federal officer that alleges a violation of section 1202 or 1211 of title 5, United States Code.

To bypass this rule, the amendment allows for a waiver or suspension in the Senate, but only through an affirmative vote of three-fifths of the Members, duly chosen and sworn. Additionally, an affirmative vote of three-fifths of the Members is required to sustain an appeal of the ruling of the Chair on a point of order raised under this rule.
