Mr. Warner submitted amendment SA 1832 to the concurrent resolution establishing the congressional budget for the United States Government for fiscal year 2025 and setting forth the appropriate budgetary levels for fiscal years 2026 through 2034.
What It Aims to Change or Add
- Point of Order: It adds a rule stating it is not in order in the Senate to consider certain reconciliation bills, joint resolutions, amendments, or conference reports if certain federal civil service laws are being violated.
- Violation Conditions: The rule applies if there is an ongoing violation of section 1341 of title 31, United States Code, as determined by the Comptroller General, or if any employees are being paid in violation of section 3103 of title 5, United States Code.
- Civil Service Pay Requirement: Section 3103 of title 5 requires civil service employees to be paid only for services actually rendered in connection with and for the purposes of the appropriation for which the employee is paid.
- Waiver and Appeal Rules: The point of order can be waived or suspended in the Senate, and an appeal of the ruling of the Chair can be sustained, only by an affirmative vote of three-fifths of the Members, duly chosen and sworn.
