What this amendment would do
-
Submitted by Ms. Warren, amendment SA 1538 was proposed for the concurrent resolution H. Con. Res. 14, which sets the congressional budget for fiscal year 2025 and outlines budgetary levels from fiscal year 2026 through 2034.
-
The purpose of this amendment is to add a new point of order to title IV that targets any legislation trying to get rid of the Department of Education.
-
Specifically, it makes it not in order in the Senate to consider any bill, joint resolution, motion, amendment, amendment between the Houses, or conference report that would abolish the Department of Education.
-
To bypass this rule, the amendment requires an affirmative vote of three-fifths of the chosen and sworn Members of the Senate to waive or suspend it.
-
Additionally, if the Chair makes a ruling on this point of order and someone wants to appeal it, it also takes an affirmative vote of three-fifths of the chosen and sworn Senate Members to sustain that appeal.
