What this amendment would do

This amendment was submitted by Mr. Kim, along with Ms. Alsobrooks and Ms. Duckworth. Its purpose is to create a point of order in the Senate against certain legislation.

Here is what the amendment aims to do:

  • It creates a rule where it is not in order in the Senate to consider any bill, joint resolution, motion, amendment, amendment between the Houses, or conference report that would limit, reduce, or eliminate access to care for children with a preexisting condition like a disability or chronic condition.

  • It stops legislation that would place a lifetime or annual cap on health insurance coverage for a child with a disability or a chronic condition.

  • It prevents legislation from allowing a health plan or provider to discriminate based on a child's physical health, mental health, or disability status in order to increase care costs, provide fewer benefits, or decrease health care access afforded under title I of the Patient Protection and Affordable Care Act or its amendments.

  • It sets a rule that this point of order can only be waived or suspended in the Senate by an affirmative vote of three-fifths of the Members, duly chosen and sworn. An affirmative vote of three-fifths of the Members is also required to sustain an appeal of the ruling of the Chair on this point of order.
