What this amendment would do
This amendment aims to change the Controlled Substances Act by adding xylazine, including its salts, isomers, and salts of isomers, to Schedule III.
The purpose of the amendment is to combat illicit xylazine by adding it to the drug schedules and outlining specific rules for its use, tracking, and penalties. Here are the main changes it makes:
- Adds xylazine to Schedule III of the Controlled Substances Act.
- Updates the definition of an "ultimate user" specifically for xylazine to cover situations involving veterinarians, animal care, and government animal-control or wildlife programs.
- Relieves existing xylazine manufacturing entities from making capital expenditures for new security standards.
- Gives delays for labeling, packaging, distribution logistics, practitioner registration, inventory, and recordkeeping requirements to help with the transition.
- Requires the Food and Drug Administration and the Drug Enforcement Administration to facilitate and expedite relevant manufacturer submissions or applications.
- Directs tracking of xylazine and orders the United States Sentencing Commission to review and potentially amend sentencing guidelines and penalties for offenses involving xylazine.
- Requires the Attorney General, through the Drug Enforcement Administration and in coordination with the Food and Drug Administration, to submit initial and follow-up reports to Congress on the prevalence and impacts of illicit xylazine use and trafficking.
