What this bill would do
The "Promoting Oversight of Wholesale Energy Reliability Act," or "POWER Up Act," clarifies that the Federal Energy Regulatory Commission (FERC) has jurisdiction over connecting large load facilities to interstate electric energy transmission facilities. It defines a large load facility as one or more facilities under common ownership at a single or contiguous site with a projected peak electricity demand of 100 megawatts or greater. The Commission is tasked with creating standardized procedures and agreements for these interconnections within 18 months. The bill also preserves state and local authority over siting, permitting, construction, retail service, local distribution, and energy generation.
