What this bill would do
This bill is called the Protecting Americans from Harmful CCP Products Act. It amends the Consumer Product Safety Act to give the Consumer Product Safety Commission stronger tools to recall dangerous items. Specifically, it targets consumer products made by manufacturers or retailers located in the People's Republic of China, including Hong Kong and Macao, that are sold directly to United States consumers. The Commission can issue a mandatory recall without the maker's consent if the product is hazardous and the company fails to respond adequately to requests for information or action. It also creates a rebuttable presumption that the Commission's claim about the hazard is correct, and requires the Commission to publish a notice 30 days before the recall takes effect. Additionally, the bill updates the definition of a distributor to include e-commerce platforms headquartered in or primarily operating from China.

Potential Positive Impacts for People
-
Section 2(a) adds a new subsection to allow the Commission to issue mandatory recalls for hazardous products from Chinese manufacturers or retailers without needing their consent, provided the company fails to give a timely or adequate response to the Commission's requests. This could protect everyday people by allowing the government to quickly pull dangerous items off the market when foreign companies ignore safety inquiries.
-
Section 2(a) requires the Commission to publish notice of any mandatory recall on its website at least 30 days before it takes effect, and to send that notice to all known distributors, importers, and platforms selling the product in the United States. This gives people and sellers advance warning before a recall officially starts.
-
Section 2(b) updates the definition of a distributor to include e-commerce platforms headquartered in or primarily operating from China that sell products to United States consumers. Holding these online platforms accountable as distributors helps ensure that foreign online marketplaces take responsibility for the safety of the goods they sell to the public.
