What this bill would do
The "Right to Override Act" aims to protect the independent judgment of health care professionals when they choose to override artificial intelligence clinical decision support systems (AI/CDSS). The bill requires covered entities to adopt policies that ensure AI does not substitute for a professional's judgment and allows for timely overrides. It also prohibits employers from taking adverse employment actions or retaliating against staff who exercise these rights. Additionally, the Act establishes an AI/CDSS committee for consultation and oversight. Finally, it provides whistleblower protections and creates enforcement mechanisms through federal agencies and private rights of action.
