What this bill would do
This bill, known as the Used Car Safety Recall Repair Act, aims to stop auto dealers from selling, leasing, or loaning used motor vehicles that have open recalls. It defines a used motor vehicle as one previously purchased for reasons other than resale. The Act establishes that a dealer cannot complete a transaction until any required defect or noncompliance is repaired. It also creates a system where manufacturers must reimburse dealers if a remedy is not made available within 60 days. Certain exceptions exist for wholesale sales or junk automobiles. The law would take effect one year after it is enacted.

Potential Positive Impacts for People
-
Consumer Safety: The bill prohibits a dealer from selling, leasing, or loaning a used motor vehicle until a defect or noncompliance has been remedied (Section 2, subsection (l)(2)). This ensures consumers are not purchasing vehicles with known safety issues.
-
Dealer Reimbursement: If a manufacturer fails to make a remedy available within 60 days of a specified date, they must reimburse the dealer at a rate determined by the Secretary (Section 2, subsection (b)(1)). This provides a financial mechanism for dealers waiting on necessary repairs.
-
Fair Market Value Protection: The reimbursement from manufacturers to dealers is capped so that the total payments do not exceed the fair market value of the used motor vehicle (Section 2, subsection (b)(1)).
Potential Negative Impacts for People
-
Dealer Financial Burden: Dealers may face situations where they have a vehicle in their possession but cannot sell, lease, or loan it until a manufacturer provides a remedy (Section 2, subsection (l)(2)).
-
Manufacturer Obligations: Manufacturers are required to pay a monthly rate to dealers that is not less than 1 percent of the fair market value of the vehicle if a remedy is unavailable (Section 2, subsection (b)(1)).
