What this bill would do
This bill, called the PROACTIV Artificial Intelligence Data Act of 2025, directs the National Institute of Standards and Technology (NIST) to create a framework for finding, deleting, and reporting child pornography in datasets used to train AI systems. This framework will provide guidelines for AI developers and data collectors. The bill also offers limited liability to AI developers and data collectors who follow the framework, unless they act with intentional misconduct, recklessness, gross negligence, or violate specific laws.

Potential Positive Impacts for People
-
Protection of Children: The core goal of the bill is to combat child pornography by detecting and removing it from AI training datasets (Section 3). This could directly benefit children by reducing the risk of exploitation and abuse facilitated by AI systems.
-
Clear Guidelines for AI Developers and Data Collectors: The framework developed by NIST will provide specific guidelines and best practices for AI developers and data collectors to identify, remove, and report child pornography (Section 3(b)). This could lead to more effective and consistent efforts to address this issue.
-
Research Support: The bill directs the National Science Foundation to support research into innovative approaches for detecting, removing, and reporting child pornography from covered datasets (Section 3(e)). This may lead to better technologies and strategies for fighting child exploitation.
Potential Negative Impacts for People
- Limited Liability: Section 4(a) grants limited liability to AI developers and data collectors who follow the NIST framework. While intended to encourage cooperation, this could shield them from accountability even if their actions cause harm due to negligence, unless it rises to the level of intentional misconduct, recklessness, or gross negligence as defined in Section 4(b).
