What this bill would do
The "Clean Cloud Act of 2025" seeks to amend the Clean Air Act to regulate data centers and cryptomining facilities. It establishes a system for the annual collection of electricity consumption data and greenhouse gas emissions intensity from "covered facilities" and their electric utilities. The bill implements an emissions performance standard by establishing regional baselines that decrease over time. Fees will be assessed on electric utilities and covered facility owners if their electricity consumption exceeds these regional baselines. The revenue generated from these fees will be used for program administration, lowering residential energy costs, and funding zero-carbon electricity and long-duration storage projects.

Does this put more money into wind, solar and other renewable power?+8
The bill allocates 70 percent of collected fees toward zero-carbon electricity and long-duration storage assets.
Does this cut the pollution that drives climate change?+7
The bill creates emissions standards and fees to incentivize zero-carbon energy and reduce the carbon footprint of data centers.
Does this put more rules on large technology companies?+6
The bill regulates the energy consumption of large-scale data centers and cryptomining facilities.
The opposite
Does this raise the taxes companies pay?-5
The bill imposes new fees on owners of data centers and cryptomining facilities based on emissions intensity.

Potential Positive Impacts for People
-
Lowering Residential Energy Costs: The bill directs that 25 percent of the funds collected from fees and penalties be used to award grants to States, Indian Tribes, municipalities, and electric utilities to support programs that lower residential electricity consumer energy costs, such as through energy use savings or direct rebates. (Section 3(c)(4)(B))
-
Funding Clean Energy Research and Deployment: 70 percent of collected funds are designated to award grants, rebates, advanced market commitments, or low-interest loans for the research, development, much more specifically for the deployment of zero-carbon electricity generation assets and long-duration energy storage assets. (Section 3(c)(4)(C)(i))
-
Increased Transparency: The bill requires the Administrator to make publicly available annual information regarding covered facilities, including their location, ownership, annual electricity consumption, and the specific power sources used. (Section 3(b)(7))
Potential Negative Impacts for People
-
Fees on Electric Utilities: Beginning in 2026, electric utilities will be assessed a fee based on the greenhouse gas emissions of the electricity consumed by covered facilities that exceeds the regional baseline. (Section 3(c)(3)(A)(i))
-
Fees on Facility Owners: Owners of covered facilities will be assessed a fee based on the greenhouse gas emissions intensity of electricity consumed from assets located behind the power meter that exceeds the regional baseline. (Section 3(c)(3)(B)(i))
-
Restrictions on Rate Increases: Electric utilities that are assessed a fee are prohibited from passing those costs onto customers who are not covered facilities by raising rates or assessing new fees; violating this can result in a fine equal to two times the amount recouped. (Section 3(c)(3)(A)(vi)(I))
