What this bill would do
This bill, known as the "Federal Investment Exception for Essential Rehabilitation Act" or the "FIXER Act," proposes to amend the Internal Revenue Code of 1986. It seeks to create an elective exception from the volume cap on tax-exempt bonds for certain exempt facility bonds. These bonds would be used for qualified residential rental projects. The exception applies to bonds used to preserve, improve, or replace qualified low-income buildings, federally assisted buildings, or State-assisted buildings. Once an election to use this exception is made, it cannot be changed.

Potential Positive Impacts for People
-
Support for Housing Rehabilitation: The bill allows issuing authorities to exempt certain bonds from the volume cap if 95 percent or more of the proceeds are used to preserve, improve, or replace specific types of buildings (Section 2(a)(2)). This could assist in maintaining qualified low-income, federally assisted, or State-assisted buildings.
-
Increased Flexibility for Property Acquisition: For bonds exempted under this act, the threshold for the prohibition on the acquisition of existing property is increased from 15 percent to 50 percent (Section 2(a)(3)).
-
Tax Credit Alignment: The bill includes an exception for certain bonds exempt from the volume cap regarding the low-income housing tax credit limitation (Section 2(b)).
Potential Negative Impacts for People
- Irrevocable Decisions: Once an issuing authority makes an election to use this exception, the decision is permanent and cannot be undone (Section 2(a)(4)).
