What this bill would do
This bill is cited as the Stopping Foreign Influence in Elections Act of 2026. It amends the Internal Revenue Code of 1986 to impose penalties and taxes on certain tax-exempt organizations that accept contributions from foreign nationals and then make contributions to political entities or committees. Under Section 2, specified tax-exempt organizations that make a disqualified political committee contribution must pay a penalty equal to twice the amount of that contribution. The bill also imposes specific taxes on the organizations making these contributions, starting at 100 percent for a first offense and increasing to 200 percent for subsequent offenses, alongside the potential loss of tax-exempt status for a two-year period for repeat offenses. Organizations are generally permitted to rely on a donor's representation regarding their nationality unless they know or should have known that the representation is false. These amendments apply to contributions made after the date that is one year after the date of the enactment of the Act.

Potential Positive Impacts for People
- Section 2 introduces financial penalties and taxes on specified tax-exempt organizations that accept contributions from foreign nationals and then pass those funds on as political committee contributions. This might be considered positive because it aims to reduce foreign influence in United States elections by penalizing organizations that funnel foreign money into political entities.
Potential Negative Impacts for People
- Section 2 imposes financial burdens and taxes on tax-exempt organizations that make disqualified political committee contributions, specifically requiring them to pay a penalty equal to twice the contribution amount and taxes equal to 100 percent or 200 percent of the contribution amount depending on the offense. This might be considered negative because it places heavy financial penalties on organizations, which could also lose their tax-exempt status for a two-year period if they make multiple violations.
