What this bill would do
This bill is called the Charitable Deductions for Digital Asset Donations Act. It changes the Internal Revenue Code of 1986 to make an exception for certain digital assets from appraisal requirements for charitable contributions. The bill sets clear definitions for terms related to digital assets, such as traded digital assets and widely traded digital assets. It also gives the Secretary authority regarding stablecoins and rules to prevent abuse. The new rules apply to taxable years beginning after December 31, 2026.

Who it would affect, and how
Potential Positive Impacts for People
- Section 2 amends Section 170(f)(11)(A)(ii)(I) of the internal revenue code to except widely traded digital assets from appraisal requirements. This could make it easier and less expensive for individuals to donate qualifying digital assets to charity without paying for a formal appraisal.
Potential Negative Impacts for People
- Section 3 establishes specific criteria for widely traded digital assets, including market capitalization exceeding $500,000,000 and ownership limits, which might exclude many smaller or newer digital assets from qualifying for the appraisal exception. This could place a heavier financial and administrative burden on individuals who wish to donate digital assets that do not meet these strict definitions.
