What this bill would do
This bill, known as the "Abolish ICE Act," seeks to eliminate U.S. Immigration and Customs Enforcement. It mandates that no Federal funds be provided for the agency's functions or duties starting on the day the Act is enacted. Any remaining unobligated funds held by the agency will be rescinded. Any other assets or liabilities belonging to the agency will be transferred to the Secretary of Homeland Security. Finally, the agency will be officially abolished 90 days after the date of enactment.

Who it would affect, and how
Potential Positive Impacts for People
-
Protection of Due Process and Safety: The bill's findings suggest that the current mission of ICE prioritizes aggressive enforcement over due process rights (Section 2, Finding 1). Abolishing the agency could address issues such as the use of unnecessary and unlawful force against civilians, seen in raids using explosives and flashbang grenades (Section s 2, Finding 5), and prevent further deaths during detainments or traffic stops (Section 2, Findings 4 and 7).
-
Improvement of Detention Conditions: The bill notes that in 2025, 32 inmates died in ICE detention due to poor conditions, including neglect and a lack of medical care (Section 2, Finding 8). Ending these operations could prevent these specific types of deaths and the associated neglect.
-
Reduction of Community Fear: The findings state that ICE has been used to "inflict terror and hysteria" and create fear within immigrant and non-immigrant communities (Section 2, Finding 10). Abolishing the agency would remove the current aggressive enforcement policies that have brought fear to these populations.
-
Prevention of Mistakes Involving Citizens: The bill notes that as many as 170 American citizens were arrested and detained by ICE in 2025 (Section 2, Finding 9) and cites a specific instance where a U.S. citizen was killed by an ICE agent (Section 2, Finding 7). Abolishing the agency would eliminate the risk of such arrests and fatal encounters involving citizens.
Potential Negative Impacts for People
-
Loss of Agency Functions: The bill directs that no Federal funds be made available for any functions, duties, or responsibilities assigned to the Director of ICE (Section 3, subsection a). While the bill aims to end current practices, it does not specify what happens to the responsibilities previously held by the agency.
-
Transfer of Assets and Liabilities: The bill requires that all assets and liabilities of ICE be transferred to the Secretary of Homeland Security (Section 3, subsection b), which may impact the administrative handling of those resources during the transition.
