What this bill would do
This bill, known as the "Securing American Firms and Expertise in Services Act," directs the Secretary of Defense to change procurement rules. The goal is to ensure contracting officers give preference to United States companies when buying professional services. This preference should be applied to the maximum extent practicable and consistent with national security. The Secretary of Defense has the authority to waive this preference under specific circumstances. These include urgent operational requirements or when no American company can fulfill the contract effectively.

Potential Positive Impacts for People
-
Preference for United States companies: This provision requires the Secretary of Defense to revise regulations so that contracting officers give preference to American businesses for professional services contracts. This is intended to favor companies organized under U.S. laws that have their principal place of business in the United States and are not controlled by foreign entities (Section 2(a)).
-
Defined scope of professional services: The bill identifies specific areas such as engineering, architecture, design, environmental consulting, financial consulting, program management, and legal services that would benefit from this preference (Section 2(c)(2)).
Potential Negative Impacts for People
-
Waiver authority for the Secretary of Defense: The Secretary of Defense can bypass the preference for American companies if it is necessary to meet an urgent operational requirement or if no United States company can meet the contract requirements in a timely or cost-effective manner (Section 2(b)(1)).
-
Potential for less frequent use of the preference: Because the preference must be applied "to the maximum extent practicable and consistent with the interests of national security," there may be instances where the preference is not applied (Section 2(a)).
