What this bill would do
The "Fair Aviation in Restrictions and Emergencies Act" or "FARE Act" aims to protect commercial flights during a lapse in appropriations. It prohibits the Federal Aviation Administration from reducing or prohibiting commercial flights unless all private aircraft flights in the same area and time are also prohibited. Certain private flights, such as those for medical, government, or humanitarian reasons, are exempt from this rule. The FAA can enforce these requirements through civil penalties or court actions.

Who it would affect, and how
Potential Positive Impacts for People
- Priority for Commercial Flights: Under Section 3(a), commercial flights cannot be restricted due to a lapse in appropriations unless private flights are restricted first. This ensures that regularly scheduled passenger flights are prioritized over private jet travel during funding gaps.
Potential Negative Impacts for People
- Restrictions on Private Flight: Section 3(a) requires the prohibition of all private aircraft flights (that are not exempt) before commercial flights can be restricted. This would burden individuals or groups using private jets for purposes not listed in the Section 3(b) exceptions.
