What this bill would do
The Mortgage Insurance Freedom Act aims to amend the National Housing Act to restrict how annual mortgage insurance premiums are collected. Under this bill, the Secretary would be prohibited from collecting these annual premiums once the remaining insured principal balance reaches 78 percent or less of the original sales price or the appraised value at the time of origination. The Secretary must establish a process for mortgagors to demonstrate they have reached this threshold and must conduct outreach and education regarding these changes. However, this restriction does not apply if the capital ratio of the Mutual Mortgage Insurance Fund falls below 2 percent. These changes apply only to mortgages endorsed for insurance after the act is enacted.

Potential Positive Impacts for People
-
Reduction in insurance costs: Mortgagors may see a stop in the collection of annual mortgage insurance premiums once their loan-to-value ratio hits a specific threshold. This applies when the remaining principal balance is 78 percent or less of the lower of the original sales price or the appraised value at origination (Section 2(a)(1)).
-
Clearer pathways for homeowners: The Secretary is required to create a specific process that allows mortgagors to demonstrate that their principal balance has met the requirements to stop premium payments (Section 2(a)(1)(iii)).
-
Increased awareness: The Secretary is mandated to conduct outreach and educational activities to ensure mortgagors are informed about the premium collection restrictions and how to demonstrate their eligibility (Section 2(a)(1)(iv)).
Potential Negative Impacts for People
-
Potential loss of benefits during financial instability: If the capital ratio of the Mutual Mortgage Insurance Fund falls below 2 percent, the restriction on collecting annual premiums may no longer apply to mortgages where the Secretary was still collecting premiums (Section 2(a)(1)(ii)).
-
Limited applicability: The benefits of this act are not retroactive and only apply to mortgages endorsed for insurance after the date of the Act's enactment (Section 2(b)).
