What this bill would do
This bill establishes a national motor carrier safety selection standard for entities that contract with certain motor carriers to transport goods. Under Section 2, a covered entity is considered reasonable and prudent in selecting a motor carrier against a claim of negligent selection if it verifies specific registration, insurance, and safety compliance requirements between 45 days before and the date of the shipment. The bill requires the Secretary of Transportation to promulgate final regulations updating motor carrier safety fitness determinations within one year of enactment. Additionally, Section 2 exempts individual shippers from having to satisfy these verification requirements to be considered reasonable and prudent in their selection. Finally, the legislation ensures that state laws relating to drayage are not preempted or superseded.

Potential Positive Impacts for People
-
Exemption for Individual Shippers: Under Section 2(d), a person acting as an individual shipper is considered reasonable and prudent when contracting with a covered motor carrier simply by demonstrating they contracted with the carrier, without needing to satisfy any of the verification requirements. This protects everyday individuals from burdensome regulatory hurdles when shipping personal goods.
-
Clear Safety Standards: Under Section 2(a)(1), covered entities are given a clear standard of care against claims of negligent selection by verifying that a motor carrier is properly registered, holds minimum required insurance, and complies with federal safety standards. This provides businesses and entities with clear rules to follow when hiring transportation services.
Potential Negative Impacts for People
- Compliance Burdens for Entities: Under Section 2(a)(1), covered entities such as shippers, brokers, and freight forwarders must actively verify a motor carrier's registration, insurance, and safety compliance between 45 days before the shipment and the shipment date. This creates mandatory administrative duties and verification responsibilities that entities must fulfill to protect themselves against negligent selection claims.
