What this bill would do
This bill, known as the "Clean Hands Firearm Procurement Act," requires the Attorney General to publish a public list of specific firearms dealers. These "covered firearms dealers" are those where the ATF has traced at least 25 firearms to their business with a time-to-crime of three years or less during at least two of the previous three years. Once listed, federal agencies are prohibited from entering into contracts with these dealers. However, the Attorney General may grant waivers to the Secretary of Defense or the Secretary of Homeland Security to protect national security. The bill includes specific requirements for notifying congressional leadership regarding any such waivers.

Potential Positive Impacts for People
-
Increased Transparency: The Attorney General, through the ATF Director, must make a list of covered firearms dealers available to the public annually (Section 2). This provides information regarding dealers with high numbers of short time-to-crime firearm traces.
-
Federal Accountability: The bill prohibits Federal agencies from entering into contracts with dealers listed during the current or previous two calendar years (Section 3(a)). This creates a standard for which businesses the government can do business with based on tracing data.
Potential Negative Impacts for People
-
Business Restrictions: Licensed dealers who meet the specific criteria of having 25 or more firearms traced with a time-to-crime of 3 years or less over at least two of the previous three years will be prohibited from receiving federal contracts (Section 3(a), Section 4(1)).
-
National Security Exceptions: The prohibition on federal contracts can be bypassed if the Attorney General grants a waiver at the request of the Secretary of Defense or the Secretary of Homeland Security to protect national security (Section 3(b)(1)).
