What this bill would do
The Advancing Skills-Based Hiring Act of 2025 establishes a voluntary compliance assistance initiative at the Equal Employment Opportunity Commission. This program aims to empower employers to adopt skills-based hiring approaches through the use of employment tests and selection procedures. Employers can proactively submit validation evidence to the Commission to ensure their methods are job-related and consistent with business necessity. The Commission will review this information and may provide technical assistance or a formal determination. Furthermore, the Act provides a safe harbor for employers who receive a positive determination. This legislation takes effect 90 days after its enactment.
