What this bill would do
This bill, known as the "Guam Temporary Workforce Act," aims to change how nonimmigrant workers enter Guam. It requires employers seeking H-2B temporary employees to first obtain a temporary labor certification from the Governor of Guam. Once that certification is issued, the Secretary of Homeland Security must approve the employer's petition. The Secretary will conclude that domestic workers are unavailable and that wages will not be negatively affected based on that certification. The Governor of Guam will also establish procedures to determine what counts as a "qualified need" for these workers.
