What this bill would do
This bill is known as the Lower Elwha Klallam Tribe Project Lands Restoration Act. It requires the federal government to take approximately 1,082.63 acres of federal land in Washington into trust for the benefit of the Lower Elwha Klallam Tribe. This land will become part of the Tribe's existing reservation. The bill also specifies how a portion of the Elwha River on this land must be managed and bans gaming on the newly trusted land. Potential Positive Impacts for People
-
Benefit for the Tribe: Under Section 2(b)(1), the federal government will take about 1,082.63 acres of federal land into trust for the benefit of the Lower Elwha Klallam Tribe. This is a positive outcome because it adds the land to the Tribe's reservation as outlined in Section 2(b)(2).
-
Protection of Treaty Rights: Under Section 3, the bill explicitly states that nothing in the Act affects treaty rights under the Treaty of Point No Point. This ensures that the existing rights of the people under that treaty remain protected.
Potential Negative Impacts for People
- Restriction on Activities: Under Section 2(e), the bill places a gaming prohibition, stating that the land taken into trust cannot be considered Indian lands for the purpose of the Indian Gaming Regulatory Act. This restricts the Tribe from using the land for gaming purposes.
